1. Games on this site are published under licence, not owned by us

PlayNova does not develop the games it publishes. Every game on this site is made by an independent studio or developer, and the copyright in each game belongs to its developer.

The games reach this site through GameMonetize, a distribution network that licenses HTML5 games to publisher websites on behalf of the developers who submit them. Each of our game pages names the provider and shows that provider's reference for the title, so any rights holder can identify exactly what is published and where it came from.

If a game has been placed into that network without the rights holder's permission, we want to hear about it. Send us a notice using the process below and we will remove the game while we investigate, and raise it with the distributor.

2. What a notice must contain

If you own a copyright, or are authorised to act for the owner, and you believe material on this site infringes that copyright, send a written notice todmca@playnova.online containing all of the following, as required by 17 U.S.C. § 512(c)(3):

• A physical or electronic signature of a person authorised to act on behalf of the owner of the right that is allegedly infringed.
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing, with enough detail for us to locate it. Please include the full URL of the PlayNova page.
• Your contact details: name, postal address, telephone number and email address.
• A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner's behalf.

Notices that leave out these elements may not be legally effective, and we may come back to you asking for the missing information rather than acting on an incomplete notice.

3. What we do when we receive a notice

• We acknowledge receipt, normally within two business days.
• If the notice is complete and appears valid, we remove or disable access to the material expeditiously.
• We notify the distribution network that supplied the game, so the same title can be addressed at source.
• We keep a record of the notice and of the action taken.

4. Counter-notification

If your material was removed and you believe that removal was a mistake or a misidentification, you may send a counter-notification todmca@playnova.online containing:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of a mistake or misidentification.
• Your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice or their agent.

We will forward a valid counter-notification to the original complainant. If they do not notify us within ten business days that they have filed an action seeking a court order, we may restore the removed material.

5. Repeat infringers

We do not knowingly publish infringing material. Where a developer or distributor is the subject of repeated valid copyright notices, we stop publishing their titles.

6. Misrepresentation

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please only send a notice if you genuinely hold or represent the rights concerned.
